The City of Mountain Brook filed a complaint against appellant charging him with committing the crime of harassing communications in violation of Ala. Code Â§ 13A-11-8(b)(1)(b) (Supp. 1981). The appellant was tried in Jefferson County Circuit Court and the jury found him guilty as charged in the complaint. Following appellants conviction the trial court conducted a sentence hearing. Taking into consideration appellants prior "difficulties with the law," the trial court set his punishment at six months hard labor in the City of Mountain Brook and, in addition, assessed a fine of $500. (R. 202,206) Appellant gave oral notice of appeal at the Conclusion of the sentence hearing. Appellant was subsequently given a hearing on his motion for new trial and the motion was denied.
